Terms of Service

1. About TalkThisWay.ai

TalkThisWay.ai (“the Service”, “we”, “us”) is an AI-assisted augmentative and alternative communication (AAC) platform operated by Brookscroft Services Inc. The Service is accessible at app.talkthisway.ai. By creating an account or using the Service you agree to these Terms.

2. Eligibility

You must be at least 18 years old, or have parental or guardian consent, to use TalkThisWay.ai. If you are registering on behalf of another person (for example as a carer or support worker), you confirm that you have authority to do so and that you will ensure their use complies with these Terms.

3. Your Account

• You are responsible for keeping your account secure. We use passwordless secure login links sent to your registered email address.
• You must not share your login link with anyone else. Each link is single-use and expires within one hour of issue.
• You must not create multiple accounts to circumvent usage limits or promotional offers.
• You may close your account at any time by contacting us at support@talkthisway.ai or using the Feedback form on the Settings page. We will delete your data within 30 days.

4. Subscriptions & Payment

• Access to the full Service requires an active subscription, except during authorised free-access periods (see Section 5).
• Subscription fees are billed in advance on a recurring basis (monthly or annual, depending on the plan you choose). All fees are stated inclusive of applicable taxes unless otherwise noted.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period, except where required by law.
• We reserve the right to change subscription pricing with at least 30 days’ notice. Price changes do not apply to your current billing period.
• Payments are processed securely by Stripe. We do not store your payment card details.

5. Free-Access Periods & Promotions

We may from time to time offer promotional free-access periods (for example, free access during a launch month). The following fair-use terms apply to all such periods:

• Free-access periods are time-limited. We will clearly communicate the start and end dates of each promotion.
• We reserve the right to apply fair-use limits on AI-generated sentence requests, voice synthesis, or other resource-intensive features during a free-access period, without prior notice.
• We reserve the right to end or shorten a promotional period at our discretion, provided we give at least 24 hours’ notice via the email address registered to your account.
• Accounts that show evidence of automated or abusive use during a free period may be suspended immediately and without notice.
• Free-access periods do not create any entitlement to continued free access beyond the stated period.

6. Your Data & Privacy

• We will never sell your personal data to third parties, ever. This is a core commitment of TalkThisWay.ai.
• Your communication history (sentences generated, words spelled) is stored securely in your account and is accessible only to you. It is used to provide the history and export features within the app.
• We may use aggregated, anonymised, non-identifiable usage statistics (for example, which word categories are used most often) to improve the Service. This data cannot be traced back to any individual.
• We use Supabase for authentication and data storage, and Stripe for payment processing. Both providers maintain industry-standard security certifications and data processing agreements. Data may be stored on servers located in Canada, the United States, or the European Union.
• You may request a copy of your data or ask us to delete it at any time by emailing support@talkthisway.ai. We will respond within 30 days.
• We retain your data for as long as your account is active. Inactive accounts (no login for 24 months) may have their data deleted after 60 days’ notice.

7. Acceptable Use

You agree not to use the Service to:

• Generate content that is unlawful, harmful, threatening, or harassing.
• Attempt to reverse-engineer, scrape, or systematically extract data from the Service.
• Circumvent any security, access control, or rate-limiting mechanism.
• Impersonate another person or create accounts under false pretences.

Breaches of acceptable use may result in immediate account suspension.

8. AI-Generated Content

• TalkThisWay Mode uses AI to generate sentence suggestions based on the context words you choose. These suggestions are assistive and may not perfectly reflect your intended meaning. Always review sentences before speaking them.
• We do not guarantee the accuracy, appropriateness, or completeness of AI-generated sentences.
• TalkThisWay.ai is an assistive tool and is not a substitute for professional speech and language therapy advice.

9. Service Availability

• We aim for high availability but do not guarantee uninterrupted access. The Service may be unavailable during planned maintenance or due to circumstances beyond our control.
• We will endeavour to provide at least 24 hours’ notice of planned downtime via the app or by email.

10. Intellectual Property

TalkThisWay.ai, its logo, design, and underlying software are the intellectual property of Brookscroft Services Inc. You may not copy, reproduce, or create derivative works without our written permission. The content you generate using the Service (sentences, spelled text) remains yours.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Brookscroft Services Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms. The current version is always available at app.talkthisway.ai/terms.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
